Washington published Children's Safe Products Act Guidance on enforcement of LEAD, CADMIUM and PHTH
12 Feb. 2016, Washington State Department of Ecology published Children's Safe Products Act Guidance on enforcement of LEAD, CADMIUM and PHTHALATE limitations. It specifies that children’s products that are not covered by federal law should in compliance with the state requirements.
According to the Guidance, Ecology will evaluate whether the product falls within the definition of “children’s product” in RCW 70.240.010, when the product is covered by the state limits, but not by a limit under the CPSIA, Ecology will enforce the state limits. For example, child car seats are not the products covered by federal law CPSIA, but they are covered by state requirements, so child car seats should be in compliance with state requirements.
